CaterZen Online Ordering Terms of Use
Effective Date: Jul 1, 2026These Online Ordering Terms of Use ("Terms") govern your access to and use of the online ordering pages, websites, mobile-accessible pages, payment pages, and related online ordering services powered by CaterZen ("Online Ordering"). These Terms apply when you use Online Ordering to view menus, submit orders, request catering services, make payments, communicate order details, or otherwise interact with an online ordering page powered by CaterZen.
By accessing or using Online Ordering, you agree to these Terms. If you do not agree, you should not use Online Ordering.
1. Who We AreCaterZen provides online ordering technology used by catering companies, restaurants, food service businesses, and related businesses that sell food, beverage, catering, delivery, pickup, or event-related services.
Unless otherwise stated, CaterZen is not the caterer, restaurant, food preparer, seller of food, delivery provider, or event service provider. The business whose menu or ordering page you are using is responsible for preparing the food, fulfilling the order, setting menu prices, confirming availability, handling order-specific questions, and providing any applicable pickup, delivery, setup, or service.
For purposes of these Terms:
"CaterZen," "we," "us," and "our" refer to Barbecue Evangelist Enterprises, Inc. d/b/a CaterZen Catering Software d/b/a Restaurant Catering Systems and its related services.
"Customer," "you," and "your" refer to the person or business placing or managing an order through Online Ordering.
"Merchant" means the caterer, restaurant, food service business, or related business that uses CaterZen to accept online orders.
2. Use of Online OrderingYou may use Online Ordering only for lawful purposes and in accordance with these Terms. You agree not to misuse the system, interfere with its operation, attempt unauthorized access, submit false or misleading information, use automated tools to scrape or copy content, or use Online Ordering in a way that could harm CaterZen, a Merchant, another Customer, or any third party.
You are responsible for making sure the information you submit is accurate, complete, and current, including your name, email address, phone number, billing details, delivery address, event date, event time, guest count, special instructions, and any other order details.
3. EligibilityOnline Ordering is intended for users who are at least 18 years old and able to enter into a binding agreement. By using Online Ordering, you represent that you are at least 18 years old and have the authority to place the order.
If you place an order on behalf of a business, organization, school, church, nonprofit, government agency, or other entity, you represent that you have authority to act on behalf of that entity and bind it to these Terms.
4. Accounts, Passwords, and SecuritySome Online Ordering features may allow or require you to create an account, save contact information, save addresses, view prior orders, or store payment-related information through a secure third-party payment processor.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to notify the applicable Merchant or CaterZen if you believe your account has been accessed without authorization.
CaterZen and/or the Merchant may suspend or restrict access to Online Ordering if we believe the account or activity is fraudulent, abusive, unauthorized, or otherwise violates these Terms.
5. OrdersWhen you submit an order through Online Ordering, you are making a request to purchase food, beverage, catering, delivery, pickup, or related services from the Merchant shown on the ordering page.
Order acceptance is subject to the Merchant’s availability, menu availability, delivery area, lead time, minimum order requirements, payment approval, staffing, and any other requirements set by the Merchant.
Submitting an order through Online Ordering does not guarantee that the Merchant can fulfill the order exactly as requested. The Merchant may contact you to confirm details, request changes, substitute unavailable items, adjust delivery or pickup details, or decline the order if it cannot be fulfilled.
You are responsible for reviewing all order details before submitting the order, including items, quantities, guest count, date, time, pickup or delivery address, fees, taxes, tips, and total amount.
6. Menu Information, Pricing, Availability, and AllergensMenus, item descriptions, pricing, photos, availability, portion guidance, nutritional details, allergen information, and other food-related information are provided by the Merchant.
CaterZen does not prepare food and does not independently verify the accuracy of menu descriptions, pricing, ingredients, allergen information, dietary labels, nutrition information, availability, or photos.
If you or anyone receiving the order has a food allergy, dietary restriction, medical condition, religious restriction, or other food-related concern, you should contact the Merchant directly before placing the order. The Merchant is responsible for answering questions about ingredients, preparation, cross-contact, substitutions, and food safety.
7. PaymentsOnline Ordering may allow you to pay by credit card, debit card, house account, invoice, gift card, cash, check, or other payment methods made available by the Merchant.
By submitting payment information, you authorize the Merchant, CaterZen, and/or their third-party payment processors to charge the selected payment method for the order total, including food and beverage charges, delivery fees, service fees, packaging fees, administrative fees, taxes, tips, surcharges, and any other amounts shown or agreed to at checkout.
Some transactions may involve authorization holds, pre-authorizations, delayed captures, deposits, final balance payments, or manual adjustments, depending on the Merchant’s settings and payment processor rules.
CaterZen may use third-party payment processors to process payments securely. CaterZen does not control every decision made by banks, card networks, payment gateways, or processors, including declines, fraud reviews, chargebacks, reversals, holds, or settlement timing.
8. Cancellations, Changes, Refunds, and No-ShowsCancellation, change, refund, deposit, and no-show policies are set by the Merchant and may vary by order, location, event date, lead time, order size, menu type, or other circumstances.
You are responsible for reviewing the Merchant’s cancellation and refund policies before placing an order. If no policy is shown, you should contact the Merchant directly before ordering.
Depending on the Merchant’s policy, you may be charged some or all of the order total if you cancel after a deadline, fail to pick up an order, are unavailable at the delivery location, provide an incorrect address, provide incorrect contact information, or otherwise prevent the Merchant or delivery provider from completing the order.
Refund requests should be directed to the Merchant unless otherwise instructed. CaterZen may assist with technology-related questions but does not independently guarantee refunds for orders fulfilled by Merchants.
9. Delivery, Pickup, Setup, and ServiceDelivery, pickup, setup, and service options are determined by the Merchant. Delivery times, pickup times, setup windows, driver assignments, delivery areas, and service availability may vary.
Delivery may be performed by the Merchant, its employees, contractors, or a third-party delivery provider. CaterZen is not responsible for the acts or omissions of any Merchant, driver, delivery provider, event staff, or third-party service provider.
You are responsible for providing a complete and accurate delivery address, contact name, phone number, delivery instructions, access information, parking or loading instructions, security or building requirements, and any other details needed to complete delivery.
Delays may occur due to traffic, weather, incorrect information, building access issues, emergencies, staffing, kitchen delays, third-party delivery issues, or other circumstances outside CaterZen’s control.
10. CommunicationsBy placing an order or creating an account, you agree that CaterZen, the Merchant, and/or their service providers may contact you about your order by email, phone, text message, or other communication methods you provide.
Order-related communications may include confirmations, receipts, payment notices, delivery updates, pickup reminders, questions about your order, refund updates, and support messages.
Standard message and data rates may apply for text messages. You may opt out of certain promotional messages where available, but transactional order-related messages may still be sent as needed to complete or support your order.
11. Promotions, Discounts, Credits, and Gift CardsPromotions, discounts, coupons, credits, gift cards, house accounts, loyalty rewards, and similar offers are subject to the terms set by the Merchant or issuing party.
Such offers may be limited, modified, suspended, or discontinued at any time unless prohibited by law. They may not be redeemable for cash unless required by law.
12. Customer Content and Special InstructionsOnline Ordering may allow you to submit notes, special instructions, delivery instructions, reviews, feedback, uploaded files, tax-exempt documents, purchase order numbers, or other information.
You are responsible for the content you submit. You agree not to submit anything unlawful, false, misleading, abusive, obscene, infringing, confidential without permission, or harmful to CaterZen, the Merchant, another Customer, or any third party.
You grant CaterZen and the Merchant permission to use the information you submit as needed to process, fulfill, support, document, and communicate about your order.
13. PrivacyYour use of Online Ordering is also subject to CaterZen’s Privacy Policy and any applicable Merchant privacy policies.
By using Online Ordering, you understand that information you provide may be shared with the Merchant, payment processors, delivery providers, communication providers, and other service providers as needed to process payments, fulfill orders, provide support, prevent fraud, and operate Online Ordering.
14. Accessibility and Merchant ContentCaterZen provides software tools that Merchants may use to create and manage online ordering pages, menus, images, item descriptions, pricing, documents, links, and other content.
Each Merchant is responsible for the content it creates, uploads, publishes, or makes available through Online Ordering, including compliance with applicable accessibility laws, rules, and requirements related to its own website content, menu content, documents, images, descriptions, and Customer-facing materials.
CaterZen is not responsible for reviewing, approving, or guaranteeing the accessibility, accuracy, completeness, or legal compliance of Merchant-created content.
15. Intellectual PropertyOnline Ordering, including the software, design, layout, features, functionality, text, graphics, logos, and related content, is owned by CaterZen, its licensors, Merchants, or other content providers and is protected by applicable intellectual property laws.
You may use Online Ordering only for its intended purpose of viewing menus, placing orders, managing orders, and communicating about orders. You may not copy, reproduce, modify, distribute, reverse engineer, scrape, frame, sell, or exploit Online Ordering or its content without prior written permission.
16. Third-Party Services and LinksOnline Ordering may include links to third-party websites or services, including payment processors, delivery providers, map services, social media pages, review sites, or Merchant websites.
CaterZen is not responsible for third-party websites, services, content, policies, availability, security, or business practices. Your use of third-party services may be governed by their own terms and privacy policies.
17. Availability and System ChangesCaterZen works to keep Online Ordering available and functioning properly, but we do not guarantee that Online Ordering will always be available, uninterrupted, secure, or error-free.
CaterZen may update, modify, suspend, or discontinue any part of Online Ordering at any time. We are not responsible for delays, errors, interruptions, lost data, or unavailable service caused by maintenance, internet issues, third-party providers, payment processors, security events, system failures, or circumstances outside our reasonable control.
18. Disclaimer of WarrantiesOnline Ordering is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, CaterZen disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and uninterrupted operation.
CaterZen does not warrant or guarantee the food, beverages, catering services, delivery services, menu information, pricing, availability, allergen information, nutritional information, food safety practices, or performance of any Merchant or third-party provider.
19. Limitation of LiabilityTo the fullest extent permitted by law, CaterZen and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and representatives will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, business interruption, personal injury, reputational harm, or the cost of substitute goods or services arising out of or related to your use of Online Ordering.
To the fullest extent permitted by law, CaterZen’s total liability for any claim related to Online Ordering will not exceed the greater of:
- the amount paid by you through Online Ordering for the specific order giving rise to the claim, or
- $100.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.
20. IndemnificationYou agree to defend, indemnify, and hold harmless CaterZen and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use or misuse of Online Ordering;
- your violation of these Terms;
- information or content you submit;
- your violation of any law or third-party right;
- your failure to provide accurate order, delivery, payment, or contact information; or
- your unauthorized use of another person’s account, payment method, or information.
If you dispute a charge with your bank, card issuer, or payment provider, the Merchant and/or CaterZen may provide order details, payment records, delivery records, communications, receipts, IP logs, and other relevant information to respond to the dispute.
You remain responsible for legitimate charges, fees, costs, and amounts owed for orders placed through Online Ordering, including amounts reversed due to chargebacks, payment reversals, or returned payments where permitted by law.
22. Suspension or TerminationCaterZen or the Merchant may suspend, restrict, or terminate your access to Online Ordering at any time if we believe you have violated these Terms, submitted fraudulent or abusive orders, misused payment methods, interfered with the system, or created risk for CaterZen, a Merchant, another Customer, or any third party.
23. Changes to These TermsCaterZen may update these Terms from time to time. Updates will be effective when posted unless otherwise stated. Your continued use of Online Ordering after updated Terms are posted means you accept the updated Terms.
You should review these Terms periodically.
24. Governing Law and VenueThese Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles, unless otherwise required by applicable law.
To the fullest extent permitted by law, any dispute arising out of or related to these Terms, Online Ordering, or your use of Online Ordering will be brought in the state or federal courts located in Davidson County, Tennessee.
25. Dispute ResolutionBefore filing a claim related to Online Ordering, you agree to first contact CaterZen and attempt to resolve the dispute informally. Please include your name, contact information, order number if applicable, Merchant name, and a brief description of the issue.
If the dispute cannot be resolved informally, any legal action will be handled according to the governing law and venue section above, unless applicable law requires otherwise.
26. Contact InformationQuestions about a specific order, refund, cancellation, delivery, menu item, allergen, tax, tip, or food-related concern should be directed to the Merchant shown on the ordering page.
